While waiting for Dahlia Lithwick to weigh in on the latest twist in the Zacharias Moussaui case, I have to conent myself with her analysis of the constitutional smack-down at the heart of Do Not Call. It includes this:
The fact that 50 million Americans signed up for the list is not constitutionally compelling…. [T]he First Amendment exists to protect unpopular speech. Fifty million Americans probably would sign up to ban speeches against the war in Iraq [ed: see Neal Pollack’s Shut Up. That goes double for poets“] or to bar Carrot Top from ever performing again.
I’d sign that Carrot Top list in an instant.
